亞太抵押校產營運？ 教育部：恐停辦
【台灣醒報記者楊蕓台北報導】亞太創意技術學院再爆欠薪！高教工會5日召開記者會指出，亞太聲稱現金不足無法支付，但實際上校產仍有10多億元，要求亞太以校產融資繼續辦學。但民進黨立委鍾佳濱坦言，現行《私校法》規定，學校不得以校地抵押借貸，用於支薪等經常性營運；教育部則回應，行政機關不得直接介入要求停辦，必須由法院決定，「若學校持續籌不到資金，很有可能決定停辦，屆時教育部將協助安置學生。」
高教工會秘書長陳政亮指出，亞太自4月董事長和校長無預警閃辭後，師生陷入前途茫茫窘境，許多學生都擔心能否在原校畢業，教職員更從5月起再次遭到全面欠薪、學校行政癱瘓廢弛。在不斷抗爭下，亞太師生原訂4日與教育部長面對面溝通，但因吳茂昆突然請辭而無法舉行。
亞太教師黃惠芝痛批，怡盛集團當年只花7千5百萬就取走亞太16億校產的經營權，2年來不但沒有新設科系，還逼迫學生轉學，如今全校只剩下8、9百位學生；教師湯仁忠則指控，學校以現金不足為由，積欠5月份薪水，引起教職員的不安，且今年畢業後，仍有3百名學生在學，「但學校卻找來律師舉辦優退說明會，要求教職員簽下離職同意書，打算把學校老師清空，相當荒謬。」
高教工會呼籲，亞太就算要「退場」，應採取「先停招，再停辦」的方式，待停招後學生全數畢業或修業年限屆滿，才能核准停辦。在過渡期間，應保留既有專業師資開足課程，不得先把教職員清空，再外找兼任教師充數。陳政亮強調，「現金不足」不應是欠薪或在還有學生的情況下無預警停辦的藉口，「且亞太仍有10億元以上校產，應優先用以融資繼續辦學，保障既有學生受教權。」
不過，民進黨立委鍾佳濱坦言，以現有校產融資繼續辦學，依現行《私校法》是不可行的。因私校法規定，捐資興學蓋校舍、買設備，都不能使用在支薪等經常性營運上，「因此當學校資金周轉困難時，不得以校地抵押借貸，因為校產不得作為日常營運不足的擔保。」
教育部技職司專委柯今尉回應，亞太要停招、停辦或籌募資金繼續辦學，將由新董事會開會決定。至於能否介入接管？柯今尉說，過去教育部可以依私校法接管或解散董事會，但2007年修法後，改成由教育部向法院提出申請，由法院決定，「學校必須籌到至少2億才可能朝『逐年停辦』的方向走，對學生衝擊較小，若籌不到錢就只好停辦，屆時教育部將協助安置學生。」
