台中一名男子，不滿妻子與廖姓刺青師發生性關係，造成他精神痛苦，提告請求兩人損害賠償80萬元。妻子辯稱是去修補刺青時遭到廖男性侵，但檢察官勘驗店內錄影監視畫面，發現女方身體「主動」配合，認定廖男不構成性侵，予以不起訴處分。民事法庭法官認定2人確實侵害男子配偶權，判決妻子與廖姓刺青師須連帶賠償新台幣20萬元，全案可上訴。
男子妻子辯稱，與廖姓刺青師認識多年，去年2月1日廖男約她下班後修補刺青，她基於信任，在對方邀約下喝了幾杯酒，之後便不勝酒力，只知道廖男清場要替她補刺青，等她恢復意識後，才發現趴在廖男身上，她立刻推開廖男，否認兩人是合意發生性行為，事後控告廖男妨礙性自主。但廖男指稱，他知道女方已婚，但女方告知他已離婚恢復單身，承認兩人有發生性行為，但並未違背女生意願。

檢查察官勘驗住處的監視錄影畫面之後，發現兩人發生性行為時，女方「主動」在上，看起來意識清醒，甚至扭動身體配合，看起來並無酒醉無法抵抗情事，認定廖男並未性侵，予以不起訴處分。民庭法官以女方及廖男侵害配偶權，判2人連帶賠償新台幣20萬元，目前男子與妻子的婚姻關係仍持續中。
