CAFC一方面說要藉由說明書來解讀claim，一方面又說不要把說明書的限制讀進claim。但是要如何區別reading a claim in light of the specification 和 reading a limitation into the claim from the specification？

 

Comark Communications, Inc. v. Harris Corp., 156 F.3d 1182, 1186-87 (Fed. Cir. 1998) (“there is sometimes a fine line between reading a claim in light of the specification, and reading a limitation into the claim from the specification”).

 

根據Phillips en banc 2005

 

不要直接把實施例的內容當作是專利保護範圍（reading a limitation into the claim from the specification）

For instance, although the specification often describes very specific embodiments of the invention, we have repeatedly warned against confining the claims to those embodiments.

 

外部證據（主要是指字典）所做的解釋不能違反說明書的涵義（reading a claim in light of the specification）

Nor is the court barred from considering any particular sources or required to analyze sources in any specific sequence, as long as those sources are not used to contradict claim meaning that is unambiguous in light of the intrinsic evidence.
