大法官會議昨在憲法法庭召開軍改釋憲案說明會，聲請人呂玉玲等立委痛批軍改剝奪退伍軍人財產權與生存權，旁聽的八百壯士成員紛紛鼓掌叫好，行政院代表則強調軍改有必要性，多位大法官爭相提問，展現對軍改制度的高度關注。
藍委痛批 軍改無依據
在野黨立委針對修法後的《陸海空軍軍官士官服役條例》聲請釋憲，大法官會議受理後，列出13項爭點，召開類似準備程序的說明會，立委由曾銘宗、吳志揚及呂玉玲代表；機關則是由年改小組執行長林萬億與24位行政院相關部會人員出庭。
由於攸關退伍軍人生計，八百壯士捍衛中華協會理事長吳斯懷與30多會員到場旁聽。立委曾銘宗說，改革需要充分溝通，政府這次軍改始終沒有提出合法的精算報告，讓大家評估年金這樣改的依據何在。
立委呂玉玲批評軍改溯及既往，侵害退伍軍人的權益，且軍人退撫給付政府要像雇主一樣，提款相關資金負責最終給付責任，不能任意支配；吳志揚也說，軍人是特殊職務，給付軍人退撫有高度公益性，不能侵害其權利。
吳志揚強調，政府沒有破產，軍人退撫基金也沒有破產，目前資金出現缺口，是因為政府3次裁減軍力，繳交退撫基金的人變少，再加上基金經營績效不好所導致，政府應負責照顧退伍軍人，不是將錢像前瞻建設一樣亂花。
退撫基金 有破產危機
行政院政務委員林萬億則說，退撫基金財務有嚴重的破產危機，其中包括18%優惠利率存款、男性平均壽命越來越長，致使領取年金的人數及時間都拉得更長，加上基金投資報酬率不高，改革有必要性及急迫性。

聽完立委及行政院代表陳述後，與會的15位大法官踴躍發問2個小時，陳碧玉大法官更一口氣問了8個問題，因問題涉及諸多資料須整理，主席司法院長許宗力裁示可書面補說明。
說明會結束前，立委呂玉玲情緒激動地說，她為了軍改召開2次公聽會，但到現場都沒有看到相關機關有作為，批評軍改侵犯人民的財產權與生存權，引發旁聽席上的退伍軍人感動鼓掌叫好。
