【台灣醒報記者楊蕓台北報導】教育部駁回台大校長遴選的「公文」，終於送達台大，卻通篇未提「准」或「駁」字眼。律師葉慶元認為，教育部試圖規避當事人提起行政訴訟的權利，但公文法律效果仍有不准的意思，台大還是可以提訴願。律師黃帝穎則分析，法院必須先認定該公文屬於行政處分，還是主管機關對受託單位（遴委會）的「職務命令」，接下來才會去談此處分是否合法，「保守估計恐要花上3到5年。」
教育部上月27日宣佈駁回台大校長管中閔聘任案，要求台大重啟遴選，事隔10天，台大「終於」在7日收到教育部公文。
團購人氣產品網路人氣產品top10公文指出，因管中閔出任台灣大獨董、審計及薪酬委員，與擔任台灣大董事（兼副董）的遴委會委員蔡明興具有特殊的重大利害關係，兩人及台大卻未曾於遴選過程揭露，而台大遴委會及校務會議都未實質處理校長遴選程序瑕疵相關爭議，因此要求重啟遴選程序。但通篇未提「准」或「駁」字眼，
省錢妙招網路熱銷遭質疑是玩文字遊戲，試圖規避當事人提起行政訴訟的權利。
「教育部對遴選結果並無實質審查權限，不能駁回，教育部自知理虧，如果打行政訴訟，教部敗訴的可能性很大。」國民黨立委柯志恩質疑，教育部在公文中刻意不提「不核准」，就是怕台大及管中閔提起行政訴訟，批評教育部敢「拔管」卻又不敢承認，此外，行政訴訟曠日廢時，可能拖延好幾年，「若這個案子懸而未決，對民進黨當然是大傷。」
「教育部不論聘或不聘，都是行政處分。」律師葉慶元主張，教育部公文要求台大遴委會重啟遴選，在法律效果上就是「不准」的意思，因此台大還是可以提訴願。至於公文中刻意不提「不核准」，是教育部沒有依法核可管中閔，又不敢直接拒絕，害怕當事人提起行政訴訟，才沒有給管中閔公文副本。
律師黃帝穎受訪時分析，行政處分的要件是「對外發生效力」，若是針對受託單位只能算對內的職務命令，因此教育部公文的確會產生見解上的分歧，「關鍵在於教育部認定遴委會是受託行使公權力遴選，最終聘任權仍在教育部，駁案則屬於職務命令或通知，要求台大重新補正程序，不算是行政處分，也不宜認定教育部是規避台大提出行政訴訟的文字遊戲。」
「台大勢必會主張，學校選出的校長被教育部駁回，這就是行政處分。」黃帝穎說，公文算行政處分還是職務命令，會先由訴願會認定，一旦訴願會認定是行政處分，台大當然有權利提行政訴訟，但若訴願認定屬職務命令，雖台大可要求法庭重新認定，甚至聲請釋憲，但保守估計恐花上3到5年，「這段時間台大校務不應空轉，依法行政、依照教育部要求重啟遴選是比較合宜的做法。」
