舊金山和約生效日暨中華民國與日本簽訂臺北和平條約

Effectivedate of the San Francisco Peace Treaty cum ROC and Japansigned a peace treaty in Taipei

 

一九五二年四月二十八日『舊金山和約』（ＳＦＰＴ）生效，中華民國最慢在九十天內撤離臺灣和澎湖群島。

April 28, 1952 "San FranciscoPeace Treaty" (SFPT) take effectninety days of theRepublic of the slowest inTaiwan and the Penghu Islands toevacuate.

 

當天中華民國卻單獨與日本簽訂：「中日和平條約」此和約確認日本依照「舊金山和平條約」業已放棄臺灣、澎湖群島、南沙群島和西沙群島的一切權利。（與舊金山和平條約相同，等於追認《舊金山和平條約》，並未明確表示這些被放棄之領土移轉給誰。）

Day of the Republic of China and Japan signedit alone: "Sino-JapanesePeace Treaty" in accordance withthe peace treaty confirmedJapan, "the San Francisco Peace Treaty"has waived all rights of Taiwan, Penghu Islands, the Spratly and Paracel Islands. (Samewith the San Francisco Peace Treaty,equal to ratify "the San Francisco Peace Treaty",made it clear that they did not give up theterritory to be transferred to anyone.)

 

也就是說，中華民國雖和日本簽訂和約，但亦沒有因此從日本手上獲得臺灣和澎湖群島的主權。

In other words, although theRepublic of China and Japan signed a peace treaty, but hasno sovereignty over Taiwan andPenghu hasreceived from the Japanesearchipelago hands.

 

美國參議院批准舊金山和約，同意臺澎自日本分離後，可依聯合國憲章獨立，臺灣獨立建國的權利，宣告確定。但是、、、。

The US Senate approved the San Francisco Peace Treaty, Japan agreed to Taiwan,Penghu, since the separation,to follow the Charter of independence,the right to an independent stateof Taiwan, declaring OK. But,,,.

 

一九五四年十二月二日美蔣協防條約在美國簽定（有技術上之暗示臺灣為中華民國的一部分），美國參議院發現錯誤，立即加註：

   『本條約不得解釋為領土主權之變更』以免被蔣介石所誤導並呼應該院於一九四五批准聯合國憲章第七六、七七條規定及一九五二所批准舊金山和約。這就是中華民國想盡辦法要把臺灣變成它的卑劣手段之一。

    December 2, 1954 in the United States signed a treaty todefend Chiang (technicallyit implies Taiwanis a part of theRepublic of China), the US Senate found an error, immediately filling:
    "This Treaty shallbe interpreted as the change ofterritorial sovereignty," so as notto be misled by the hospitaland echoes seventhSix Weeks provisionand one thousand nine hundred fifty-tworatified Treaty of San Francisco in one thousand nine hundred forty-fiveChiang approval ofthe UN Charter. That's Republicof China to find ways to make Taiwan become one of its despicablemeans.
