勞動部今(29)日提醒,排(輪)班之部分工時勞工,即使非每日出勤,只要雙方持續具有僱傭關係,雇主依規定應在勞工到職當日申報勞工保險、就業保險及勞工職業災害保險,並於勞工離職當日申報退保;若只在上班當天加退保屬於違法,而常見違規行業類別包括飯店、住宿和餐飲等。

勞動部提醒,對於持續排班的勞工,雇主不應只在排班當天加退保。圖/記者王詩婷攝勞保局納保組長吳依婷表示,如果勞工與雇主之間存在持續性僱傭關係,即使是輪班制,雇主也應從勞工到職日起,持續為其申報參加勞工保險、就業保險及勞工職業災害保險,直到勞工實際離職日才能申報退保,只在上班當天加退保是違法的。
吳依婷強調,對於「持續排班」的勞工,雇主不應只在排班當天加退保。他補充,常見違規行業包括飯店、住宿和餐飲業等。
勞動部舉例說明,阿芳自1月1日起受僱於某飯店擔任房務人員,每週依飯店安排排班4天,阿芳雖非每日上班,但雇主持續排班指派工作,雙方持續具有僱傭關係,依規定雇主應自阿芳到職當日(即1月1日)申報加保,並持續投保至阿芳實際離職日為止。
惟如該飯店為節省保費,每次於阿芳來上班當天才辦理加保並於同日退保,即屬違法,雇主未加保期間,將依《勞工保險條例》及《就業保險法》規定,處應負擔保險費金額之4倍及10倍罰鍰,勞工所受之損失應由投保單位賠償;另依《勞工職業災害保險及保護法》規定,應核處新台幣2萬元至10萬元罰鍰並公布違規事由。
