被判定為means-plus-function，而說明書中沒有means的對應structure，claim就會invalid。


美國專利法第112條 第6段
An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof.
所以，claim中的element，若沒有把握不是means plus function，該element的圖式最好不要只是一個box，說明書中最好不要只是一個名稱而已，敘述一下該element的structure吧。
記住，不是不寫means就不是means plus function；也不是寫了means就是means plus function。
