許忠信為私地遭強占抱不平

無黨籍台南市長參選人許忠信七日抨擊從台南縣政府到現在台南市政府，都出現政府機關占用私地充作道路或其他用途，既不徵收也不補償的情形，若他當選台南市長，會儘量協調，讓地主和市府以「非訴訟」的方式解決爭端。
許忠信表示，從民國八十年代起，縣府就針對多筆土地，以「公益需求」為理由，占用私人土地充作道路或是其他用途，當地主要求縣府依法徵收時，縣府卻常用「行政機關內部權責區分」、「行政機關裁量權限」或「經費不足」為由，拒絕辦理徵收，或是不依法發給徵收補償費。
縣市合併後也是「蘇歸賴隨」，市議員曾在市議會多次質詢，但市府都以「等以後經費充足後將會處理」的理由塘塞。
他接獲的民眾陳情資料，到目前已有五十七筆，面積達三萬一千多平方公尺，但實際上還不只這些。
許忠信表示，台南地方法院在民國八十九年度訴字第二一五三號民事判決中，就已明確認定這種「土地遭國家占用，但國家卻沒有給地主任何補償」的作為，就是一種民事上的不當得利，而依民法第一七九條以下的規定，市政府必須給地主「相當於租金」的補償數額。
為了保障私人地主權益，及避免因承辦人員的錯誤或不完整的法律認知，造成市府更大的負擔，他若當選市長，必定會儘量協調此種對地主不甚公平的情形，讓地主和市府可經由調解或其他「非訴訟」的方式解決爭端，以避免市府日後因法院判決，而陷入更不利或難以解決的困境。
