新北市一名74歲胡姓老翁與妻子長期分居台、美兩地，2015年4月胡妻回國後，懷疑老公偷吃林姓女護理師，便偷偷安裝監視器，果然錄到老公和林女8次偷腥畫面，憤而提出告訴。不過新北地院審理時勘驗性愛畫面，發現8段影像都沒有顯示日期，認為無法證明2人通姦行為是否有超過6個月告訴期，因此判胡翁、林女無罪。
胡姓老翁和妻子分居台灣和美國兩地，胡翁因為長年在林口長庚看併，認識41歲林姓女護理師，2015年3月間林女離開長庚，隨即搬進胡翁家裡居住；同年4月胡妻回台發現此事，偷偷在丈夫臥房裝設錄影器材後返美，至同年10月份再返台，取得8段胡翁與林女的性愛影片，提出告訴。
法官勘驗影片，發現8段影像都沒有顯示錄影時間，無法證明提告時是否超過6個月告訴期，且胡妻偷拍丈夫臥室長達半年，嚴重侵害隱私權，加上胡翁和胡妻都指稱婚姻早已出現問題，2人已經互提離婚、損害賠償、妨害秘密等訴訟，可見婚姻已難維持，因此判胡翁、林女無罪。
